Window Tint
W. Va. Code § 17C-15-36a — thirty-five percent light in, twenty percent reflectivity at most, and five inches along the windshield
- On the windshield, tint is nonreflective, not red, yellow or amber, and only along the top, no lower than the line marked on the glass or five inches from the top, whichever is closer to the top.
- On the side windows beside the driver, tint has a light transmission of not less than thirty-five percent and a reflectivity of not more than twenty percent.
- Windows behind the driver may be tinted to the same figures, and then the car needs a mirror on each side.
The light transmission figure does not apply to windows behind the driver on trucks, buses, trailers, mobile homes and multipurpose vehicles, and tint put on at the factory is exempt.
A medical affidavit. A person whose physician or optometrist signs an affidavit that a condition requires darker tint is exempt, and the affidavit stays with the person whenever they ride in the car.
A violation is a misdemeanor with a fine of not more than $200. A particular ticket is a question for a licensed West Virginia attorney.
