A Dismissed Case
W.S. 7-13-1401 — an arrest or dismissed charge expunged after 180 days, with no filing fee
A person may ask the court where the case was, or would have been, to expunge records of an arrest, charges or dispositions once at least 180 days have passed since the arrest or the dismissal, with no formal charges pending and no deferred disposition on any charge from that incident, including a lesser one.
Who handles this in Wyoming: Wyoming State Bar, attorney referrals; and legal aid programs and the state offices, listed in the Wyoming directory.
- One of these must also be true: no conviction came from the incident, no criminal charges were filed, or every proceeding was dismissed by the prosecutor or the court.
- There is no filing fee.
- The prosecuting attorney has twenty days after service to object. With no objection, the court may enter the order without a hearing.
After the order. A person whose record is expunged under this section may answer any inquiry as though the arrest or charges never happened, unless another law says otherwise. The court file is sealed.
