A Small Estate
W.S. 2-1-201 — an affidavit after thirty days, for an estate up to $400,000
At least thirty days after a death, whoever owes the person money or holds their belongings pays or hands them over to the heirs who present a sworn affidavit, filed with the clerk, that the Wyoming estate is worth no more than $400,000 after liens.
Who handles this in Wyoming: Wyoming State Bar, attorney referrals; and legal aid programs and the state offices, listed in the Wyoming directory.
- The affidavit also states that no personal representative has been applied for or appointed in Wyoming, and the facts of each heir's relationship and right to the property.
- For real estate, including mineral interests, the heirs may apply to the court, at least thirty days after the death, for a decree of summary distribution.
- That application carries a sworn report of value, and notice is published once a week for two consecutive weeks.
