Fireworks In The Yard

A.R.S. 36-1606 — consumer fireworks are statewide, with dates a city may enforce

In Arizona, the sale and use of permissible consumer fireworks are a matter of statewide concern, and a city, town or county may regulate them further only in the ways the section lists.

The use dates a local government may keep. In a county of more than five hundred thousand people, a city, town or county may prohibit the use of permissible consumer fireworks on days other than May 4 through May 6, June 24 through July 6, December 26 through January 4, and the second and third days of Diwali. In a smaller county, the window is June 24 through July 6 and December 26 through January 4.

Hours and fire restrictions. In the larger counties, use may be prohibited on all days between 11:00 p.m. and 8:00 a.m., except from 11:00 p.m. on December 31 through 1:00 a.m. on January 1, and from 11:00 p.m. on July 4 through 1:00 a.m. on July 5. Use may also be prohibited during a stage one or higher fire restriction near the preserves, parks and forests the section names.

Local ordinances, homeowners' association rules, fire restrictions, and the licensing of sellers and display operators run alongside these sections and are not all on this page. Whether a particular device or a particular night is allowed where someone lives is a question for the local fire authority or a licensed Arizona attorney.
