Physical Control
A.R.S. 28-1381 — unlawful to drive or be in actual physical control of a vehicle while impaired to the slightest degree
Drive, or be in control. It is unlawful to drive or be in actual physical control of a vehicle in Arizona while under the influence of intoxicating liquor, a drug, a toxic vapor, or a combination, if the person is impaired to the slightest degree.
The two hours. It is also unlawful with an alcohol concentration of 0.08 or more within two hours of driving or being in actual physical control, where the alcohol was consumed before or while driving or being in control.
The section reaches control as well as driving, but does not itself define actual physical control. Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed Arizona attorney.
