The Gift Card
A.R.S. 44-7402 — no fees, and money on the card that does not expire
In Arizona, a gift card may not be subject to a fee, and the underlying monies on a gift card may not be subject to an expiration date.
The card may expire, the money may not. The card itself, or a code or device tied to it, may carry an expiration date, but only if the card clearly and conspicuously discloses that the underlying monies do not expire and that the consumer may contact the issuer for a replacement card, code or device. For an electronic gift card, the disclosure is in the message carrying the card number or code.
The section does not apply to free awards, loyalty or promotional cards, cards sold below face value to or donated to charities, or prepaid phone, transfer and general purpose debit cards not marketed as gift cards. Its sole penalty is a civil penalty of not more than five hundred dollars per card. Whether a card is covered is a question for a licensed Arizona attorney.
