Hurt at Work
C.R.S. 8-43-102 — written notice to the employer within ten days, and a claim filed within two years
An employee in Colorado injured in an accident notifies the employer in writing within ten days after the injury. The employer marks the date and time it received the notice and gives the employee a copy within seven days.
Who handles this in Colorado: legal aid programs and the state offices, listed in the Colorado directory.
The notice employers must post says it plainly: an employee who does not report promptly may still pursue a claim, and an employer policy contrary to the reporting rules is against the law.
Two years to claim. The right to compensation is barred unless a notice claiming compensation is filed with the division within two years after the injury, or after a death resulting from it, with longer periods for certain occupational diseases.
