When They Take the Car Back
C.R.S. 5-5-111 — twenty days after a notice of right to cure, before repossession for a missed payment
In a Colorado consumer credit transaction, after a default that is only a missed payment, the creditor may neither accelerate the balance nor take the collateral until twenty days after giving the consumer a notice of right to cure.
Who handles this in Colorado: Bankruptcy Clinic, U.S. Bankruptcy Court for the District of Colorado; and legal aid programs and the state offices, listed in the Colorado directory.
Until that period runs out, the consumer may cure by paying all unpaid sums due at that time, without acceleration, plus any unpaid delinquency or deferral charges, which restores the consumer's rights under the agreement.
The section limits how often the right to cure applies. A particular agreement is a question for a licensed Colorado attorney.
