A Sale at the Door
6 Del. C. § 4404 — 3 business days to cancel, a refund within 10 business days, and no knocking after 8 p.m.
3 business days. A buyer in a door to door sale may cancel without penalty within 3 business days after the transaction. The seller hands over a completed contract or receipt in the language of the sales pitch, with a notice of cancellation form attached.
- After a valid cancellation, the seller refunds every payment, returns any trade in, and cancels any note, within 10 business days.
- Goods are made available at the buyer's home, and if the seller does not pick them up within 20 days, the buyer may keep them without further obligation.
- A salesperson soliciting at a home displays an identification card from the Department of Finance with the seller's name, phone, address and business license number.
- Door to door soliciting is allowed only between 9 a.m. and 8 p.m., with fines of $75 to $150, then $100 to $250, for breaking that.
Failing to honor a cancellation is an unlawful practice under the consumer fraud law. A particular sale is a question for a licensed Delaware attorney.
