The Hospital Bill
6 Del. C. § 2507J — no medical debt on a credit report, no interest, and a payment plan capped at 5% of income
Not on a credit report. No one may report medical debt to a consumer reporting agency, and an agency may not include it in a consumer report.
- No interest or late fees may be charged on medical debt, whatever the agreement says, and that holds for judgments on it too.
- Large health care facilities and medical debt collectors offer a payment plan on debts of $500 or more, with monthly payments of no more than 5% of gross monthly income.
- No first payment is due within 30 days after the care, within 30 days after the first bill, or while the creditor is waiting on documents from the patient.
- While an insurance appeal is pending, or was within the previous 60 days, a creditor that knows of it may not report, contact the patient to collect, or sue.
