What Creditors Cannot Take
10 Del. C. § 4913 — most of each paycheck, 1 garnishment at a time, and clothing, books and family items
Most of the paycheck. Eighty five percent of a Delaware resident's wages is exempt from attachment, except for a fine, costs or taxes owed the State. Only 1 attachment may be made on any amount of wages due.
- The family Bible, school books, family library and family pictures.
- A church pew, and a burial lot.
- All the clothing of the debtor and the family.
- Tools of the trade, up to a small set value by county.
- For the head of a family, other personal property up to $500 of the debtor's choosing.
