Equal Pay
19 Del. C. § 1107A — equal pay for equal work regardless of sex, recovered as unpaid wages
No employee may be paid less than an employee of the opposite sex in the same establishment for equal work requiring equal skill, effort and responsibility under similar conditions.
- A difference is allowed only under a seniority system, a merit system, a system measuring production, or another factor other than sex.
- An employer may not fix a difference by lowering anyone's pay.
- Amounts withheld in violation are treated as unpaid wages.
