Getting Paid
19 Del. C. § 1102 — a payday at least once a month, wages within 7 days of the pay period, and attorney's fees in a suit
- Wages are paid on regular paydays set in advance, at least once each calendar month.
- They are paid within 7 days after the close of the pay period in which they were earned.
- If payday falls on a nonwork day, payment comes on the workday before.
- On written request, the employer may pay by deposit to the employee's bank account.
An employee may sue for unpaid wages and liquidated damages, and a judgment for the employee includes the costs of the action and reasonable attorney's fees.
The Department of Labor also takes wage claims. A particular claim is a question for a licensed Delaware attorney.
