10 Del. C. § 4515 — no firing for a jury summons, and 90 days to sue for lost wages and the job back

An employer may not fire, threaten or coerce an employee for receiving a jury summons, responding to it, serving, or attending court for jury selection.

  • An employer who violates it is guilty of criminal contempt, with a fine up to $500, up to 6 months, or both.
  • A fired employee may sue in Superior Court within 90 days for lost wages and reinstatement, and a winning employee is awarded a reasonable attorney's fee.
