29 Del. C. § 10004 — every meeting open, 7 days' notice with the agenda, and executive sessions voted on in public
Every meeting of a public body is open to the public, except an executive session closed for a purpose the law allows.
- Regular meetings, and any intent to hold an executive session, are noticed at least 7 days in advance, with the agenda if it has been set.
- An executive session is held only after an open vote of a majority of members present, with the result recorded in the minutes.
- Emergency meetings for public peace, health or safety are outside the notice rule.
Undoing a decision. Any citizen may challenge an action taken in violation by suing in the Court of Chancery within 60 days of learning of it, and no later than 6 months after it, or by petitioning the Attorney General.
