Registering to Vote

15 Del. C. § 2050A — registered automatically at the Division of Motor Vehicles, with a notice to decline

A person who shows proof of citizenship in business with the Division of Motor Vehicles, is eligible and not registered, is sent to the Department of Elections for registration. The Department mails a notice with a return form to choose a party or decline, and a person who declines is treated as never registered.

Once registered, a voter stays on the rolls while living in the State, unless disqualified or canceled under the law. A voter who moves within the State or changes their name updates the record.

The deadline. The code still says the last day to register is election day. The Delaware Supreme Court has held that registering on election day conflicts with the State Constitution, so the registration deadline the Department of Elections publishes before each election is the one that applies.
