When Your Data Is Breached
6 Del. C. § 12B-102 — notice within 60 days, the Attorney General told above 500 residents, and a year of credit monitoring for a Social Security number
A business that owns or licenses computerized personal information gives notice of a breach to every Delaware resident whose information was, or is reasonably believed to have been, breached, unless an investigation finds it unlikely to cause harm.
- Notice comes without unreasonable delay, and not later than 60 days after the breach is determined, with narrow exceptions.
- Where more than 500 Delaware residents are affected, the Attorney General is notified too.
- Where Social Security numbers were breached, each affected resident is offered credit monitoring at no cost for 1 year.
