Deceptive Business Practices
Fla. Stat. 501.204 — unfair or deceptive acts, actual damages, and fees
Under Florida's Deceptive and Unfair Trade Practices Act, unfair methods of competition, unconscionable acts or practices, and unfair or deceptive acts or practices in the conduct of any trade or commerce are unlawful.
Anyone aggrieved by a violation may sue for a declaratory judgment and an injunction. A person who suffered a loss may recover actual damages, plus attorney's fees and court costs, except against a retailer who in good faith passed along a manufacturer's or wholesaler's claims without knowing they violated the act.
Attorney's fees can go either way. In litigation over a violation, the prevailing party, after judgment and any appeals, may receive reasonable attorney's fees and costs from the side that lost, whichever side that is.
