The Gift Card

Fla. Stat. 501.95 — no expiration date and no fees, with a few exceptions

In Florida, a gift certificate purchased or a credit memo issued in the state may not have an expiration date or period, or any postsale charge or fee, including service charges, dormancy fees, account maintenance fees or cash out fees.

  • A gift certificate given as a charitable contribution may expire, but not in less than 3 years.
  • One given as a benefit of an employee incentive program may expire, but not in less than 1 year.
  • One given free under a loyalty or promotional program may expire, as the section allows.
  • Any permitted expiration date is prominently disclosed in writing when the certificate is provided.

A gift certificate covers a gift card or stored value card bought for money, and a credit memo one issued for returned merchandise. Tickets and discount coupons are outside the section. Whether a card is covered is a question for a licensed Florida attorney.
