Fla. Stat. 817.568 — criminal use of personal identification information

In Florida, willfully and without authorization using, or possessing with intent to use, another person's personal identification information without their consent is fraudulent use of personal identification information, a felony of the third degree. The information covered includes a name, address, phone number, social security number, date of birth, license number, account and card numbers, biometric data and medical records.

A second degree felony at $5,000. Using it is a felony of the second degree, with a mandatory minimum of 3 years in prison, where the benefit or the fraud is $5,000 or more, or where the information of 10 or more but fewer than 20 people is used.
