Canceling a Door to Door Sale
HRS 481C-2 — until midnight of the third business day, and a refund within ten business days
In a door to door sale, the seller gives the buyer a completed contract or receipt stating that the buyer may cancel at any time before midnight of the third business day after the transaction, and two copies of a notice of cancellation form, and tells the buyer of the right out loud.
Who handles this in Hawaii: Office of Consumer Protection; and legal aid programs, lawyer referral and the state offices, listed in the Hawaii directory.
- A door to door sale includes one solicited in person and signed somewhere other than the seller's business address, but not one negotiated at the seller's permanent store.
- On a valid cancellation, the seller refunds all payments and returns any trade in within ten business days.
- The buyer makes delivered goods available at home; if the seller does not pick them up within twenty days of the notice, the buyer may keep or dispose of them.
- The seller may not sell the buyer's note to a finance company before midnight of the fifth business day.
Each of those failures is an unfair or deceptive practice. A business day is any day except Saturday, Sunday, or a state or federal holiday.
