Suing the State
HRS 662-4 — liable like a private person for its employees' torts, and two years to sue
The State waives its immunity for the torts of its employees, and is liable in the same manner and to the same extent as a private individual in like circumstances, except for interest before judgment and punitive damages.
Who handles this in Hawaii: legal aid programs, lawyer referral and the state offices, listed in the Hawaii directory.
A tort claim against the State is forever barred unless the action is begun within two years after it accrues. A medical tort claim follows a separate limitation.
