After A Crash
Idaho Code § 49-1302 and Idaho Code § 18-8007 — stop, trade information, report injuries or damage over $1,500, and a felony for leaving an injury crash
A driver in a crash that damages a vehicle driven or attended by someone stops at the scene, or as close as possible, and stays until the law's requirements are met. On a divided highway or interstate, the stop is made by moving to the shoulder, emergency lane or median where the car can be driven safely, and moving it does not by itself make the driver at fault.
Name, address, license, registration, insurance. At the scene the driver gives a name and address and, if available, shows the driver's license, proof of registration and proof of liability insurance to the other driver or the person struck. Willfully failing to, or knowingly giving false information, is a misdemeanor.
A crash causing injury, death, or damage to one person's property over $1,500 is reported immediately, by the quickest means, to the city police, or outside a city to the sheriff or the state police.
An injury crash. A driver who knows or has reason to know a crash injured or killed someone stops, stays, gives name, address, insurer and registration number, shows a license if available, and renders reasonable assistance, including arranging a trip to medical care. A violation is a felony carrying up to $5,000 or five years, and a one year license revocation.
Failing to stop after a damage-only crash is a misdemeanor. Fault and insurance claims are separate questions. A particular crash is a question for a licensed Idaho attorney.
