Fireworks In The Yard
Idaho Code § 39-2606 and Idaho Code § 39-2609 — June 23 to July 5, December 26 to January 1, and only the nonaerial kind
Two windows a year. Nonaerial common fireworks may be sold and used from midnight June 23 to midnight July 5, and from midnight December 26 to midnight January 1. The local authority may extend each period of sales by up to five days. At other times fireworks need a permit.
- Altering any fireworks.
- Throwing fireworks from, into or at a moving vehicle, or at a person.
- Selling or using fireworks outside the permitted times.
- Using fireworks in an area the county has declared a severe fire threat, with notice given in advance.
Altering fireworks or using them outside the permitted times is an infraction with a $100 fine. Most other violations of the chapter are misdemeanors, and fireworks used in violation may be confiscated.
Parents and others with custody of a minor are liable for damage the minor causes with fireworks. Retail sales of nonaerial fireworks are made only from a temporary fireworks stand, unless the local authority allows a variance.
