Idaho Code § 49-672 — a child safety restraint for a child six or younger
Six or younger. A driver may not carry a child six years of age or younger in a vehicle built with seat belts unless the child is properly secured in a child safety restraint meeting the federal standard.
Where every seat belt is in use, an unrestrained child rides in the rear seat if there is one. A child may be taken out of the seat to be nursed or cared for.
Not using a car seat is not evidence of negligence in a civil case.
