Tobacco and Vapes Under Twenty One
720 ILCS 675/1 — no tobacco, e-cigarettes or nicotine products for anyone under 21
No one may sell, buy for, sample or furnish any tobacco product, electronic cigarette or alternative nicotine product to anyone under 21 years of age. A seller checks a government photo ID from anyone who appears to be under 30.
Who handles this in Illinois: Illinois State Bar Association, Illinois Lawyer Finder; and legal aid programs and the state offices, listed in the Illinois directory.
No clerk under 16, with one family exception. No one under 16 years of age may sell these products in a store, unless the clerk is the son or daughter of the owner of a family owned business. Using a false or forged ID to get them under 21 is also barred.
The penalties are set out further in the same act and are not covered here. A particular ticket is a question for a licensed Illinois attorney.
