A Wage Claim

Iowa Code § 91A.10 — a written complaint to the labor director within one year of the wages coming due

  • On an employee's written complaint, the director may decide whether wages went unpaid and take an assignment of the claim to recover them, with liquidated damages.
  • The director does not accept a complaint more than one year after the wages became due.
  • If the director decides not to act, the employee is told within 14 days.

Retaliation. An employer may not fire or discriminate against an employee for filing a complaint, assigning a claim, suing, or helping another's case. A complaint of retaliation goes to the director within 30 days.
