Iowa Code § 915.23 — no firing or pay cut for serving as a witness in a criminal case
An employer does not discharge an employee, act on a promotion, or reduce wages or benefits for time actually worked because the employee served as a witness in a criminal proceeding, or as a plaintiff, defendant or witness in a civil case under chapter 235F or chapter 236, the domestic abuse chapter.
- An employer who violates the section commits a simple misdemeanor.
- The employee may recover damages, including actual damages, court costs and reasonable attorney fees.
- The employee may also ask the court for a cease and desist order and reinstatement to the previous position.
