Getting Married
K.S.A. 23-2505 — a license no sooner than the third calendar day after applying, and no one under 16 without a judge
The clerk or judge of the district court issues a marriage license no sooner than the third calendar day after the application is filed, counting Sundays and holidays. A judge may waive the wait in an emergency or extraordinary circumstances.
Who handles this in Kansas: legal aid programs, lawyer referral and the state offices, listed in the Kansas directory.
- No license issues for anyone under 16, except that a judge may approve a 15 year old's marriage after investigating, when it is in that person's best interest.
- Someone 16 or 17 needs the express consent of a parent or guardian and of the judge, or of both living parents and any guardian without the judge.
- Consent not given in person is shown by a written, attested certificate.
