Lease Terms That Do Not Count
K.S.A. 58-2547 — no waiver of the act's rights, no confessed judgment, no attorney fee clause, and no liability waiver
- A term waiving rights or remedies under the residential landlord and tenant act.
- A term authorizing anyone to confess judgment on a claim from the lease.
- A term making either side pay the other's attorneys' fees.
- A term excusing or limiting either side's liability under the law, except that a tenant may agree to limit the landlord's liability for fire, theft or breakage in common areas.

Any such term is unenforceable. A landlord who knowingly uses a lease with one owes the tenant actual damages.
A notice to vacate with extra terms. A landlord's form for a tenant's notice of moving out that adds terms not in the lease has to carry a bold warning that signing may bind the tenant to them. Without it, the signature binds the tenant to none of the added terms.
