Discrimination at Work
KRS 344.040 — no firing or refusing to hire for race, color, religion, national origin, sex, age forty and over, or disability
An employer may not refuse to hire, discharge, or otherwise discriminate because of race, color, religion, national origin, sex, age forty and over, a qualified person's disability, or being a smoker or nonsmoker who follows the workplace smoking policy.
- A complaint to the commission is filed within 180 days after the practice.
- The commission decides within 30 days after filing whether there is probable cause.
- A person injured by a violation may also sue in Circuit Court for actual damages, costs and attorney's fees.
