Rent and the Lease
KRS 383.570 — a lease cannot waive the tenant's rights or make the tenant pay the landlord's lawyer
- Rent is due without demand at the time and place agreed; if nothing is agreed, it is payable at the unit, at the beginning of each month.
- Without a definite term in the agreement, a tenancy is month to month, or week to week for a roomer paying weekly.
- Unless agreed otherwise, rent is apportioned day to day.
A rental agreement may not have the tenant waive rights or remedies under the act, authorize a confession of judgment, agree to pay the landlord's attorney's fees, or excuse or limit the landlord's liability under law or indemnify the landlord for it. A provision like that is unenforceable.
These sections are part of the landlord tenant act, which applies where the city or county has adopted it.
