La. R.S. 9:307 — a covenant marriage ends only on listed grounds, after counseling, such as two years apart

A spouse in a covenant marriage may get a divorce, after the spouses obtain counseling, only by proving one of these:

  • La. R.S. 9:307
  • Adultery, or a felony sentenced to death or hard labor.
  • Abandonment of the home for a year with a constant refusal to return.
  • Physical or sexual abuse of the spouse or a child of either spouse.
  • Living separate and apart continuously, without reconciliation, for two years.
  • One year apart after a judgment of separation from bed and board, or a year and six months if there are minor children.

The counseling requirement does not apply when the other spouse has physically or sexually abused the spouse seeking the divorce or a child of either spouse.
