La. R.S. 9:3538 — a home solicitation sale can be cancelled until midnight of the third business day
Until midnight of the third business day. A consumer may cancel a home solicitation sale until midnight of the third business day after the day the consumer signs the agreement or offer to purchase.
- Cancellation is written notice to the seller at the address in the agreement, in any form that shows the consumer does not want to be bound.
- A mailed notice counts when it is put in a mailbox, properly addressed with postage paid.
- There is no right to cancel where the consumer asked for goods or services without delay because of an emergency, and the seller already began work in good faith.
A home solicitation sale is a consumer credit sale, other than of a motor vehicle or farm equipment, solicited in person somewhere other than the seller's business, and includes a telephone sale the seller started that is agreed to at the consumer's home.
