La. R.S. 51:1944 — four repair attempts, or forty-five or more days out of service, and the maker replaces or refunds

A nonconformity is a defect or condition that substantially impairs the use or market value of a new motor vehicle bought for personal, family or household use and covered by the maker's express warranty.

Replace or refund. If after four or more attempts, within the warranty term or one year from delivery, whichever is earlier, the defect is not repaired, or the vehicle is out of service for repair a total of forty-five or more calendar days during the warranty, the manufacturer replaces the vehicle with a comparable new one or takes it back and refunds the full price, collateral costs included, less a reasonable allowance for use.

  • If the manufacturer has a qualifying informal dispute procedure, the consumer uses it first.
  • The replacement or refund is due within 30 days after the consumer offers to transfer title.
  • Suit is filed within three years from purchase or one year after the warranty ends, whichever is longer.
  • The lemon law does not limit any other remedy the consumer has.
