Unfair and Deceptive Practices

La. R.S. 51:1409 — actual damages for a deceptive practice, tripled if the business kept on after notice from the attorney general

Unfair methods of competition and unfair or deceptive acts or practices in any trade or commerce are unlawful.

  • A person who loses money or property because of one may sue individually, not as a class, for actual damages.
  • If the practice was used knowingly after the attorney general put the business on notice, the court awards three times the actual damages.
  • A winning plaintiff recovers reasonable attorney fees and costs, and a suit found groundless and brought in bad faith can cost the plaintiff the other side's fees.

One year. The action is subject to a liberative prescription of one year, running from the transaction or act that gave rise to it.
