What the Landlord Promises
La. C.C. art. 2696 — the home is warranted fit for living in and free of defects that prevent that use
The lessor delivers the home at the agreed time and in good condition, suitable for the purpose it was leased for.
- The lessor warrants that the home is suitable for its purpose and free of vices or defects that prevent that use, including defects that appear after move-in that are not the tenant's fault.
- The warranty covers defects the lessor did not know about, but a tenant who knew of one and did not tell the lessor may recover less.
- The lessor warrants peaceful possession, and in a residential lease that includes disturbance by someone with the lessor's consent to be there, or living on the lessor's property next door.
- During the lease, the lessor may not make alterations to the home.
