Who Cannot Have a Gun
15 M.R.S. § 393 — a crime punishable by a year or more, and certain protection orders
- No one convicted here of a crime punishable by one year or more, or elsewhere of one punishable by more than one year, owns, possesses or controls a firearm. A violation is a Class B crime.
- The same goes for a conviction for a crime committed with a firearm against a person, or with another dangerous weapon.
- A juvenile adjudication for conduct that would have been such a crime, where bodily injury was threatened or caused, bars possession too; a violation is a Class C crime.
- So does a court order, issued after a hearing with notice, restraining the person from harassing, stalking or threatening an intimate partner or the partner's child.
