Earned Sick And Safe Leave

Lab. & Empl. § 3-1304 — 1 hour for every 30 worked, paid at 15 or more employees

1 hour for every 30. Earned sick and safe leave accrues in Maryland at a rate of at least 1 hour for every 30 hours an employee works. An employer with 15 or more employees pays it at the employee's normal wage rate; one with 14 or fewer provides it unpaid at least.

An employer does not have to let an employee:

  • Earn more than 40 hours in a year.
  • Use more than 64 hours in a year, or hold more than 64 hours at any time.
  • Use leave during the first 106 calendar days on the job.
  • Carry over more than 40 unused hours into the next year.

Unused leave is not owed as pay when the job ends, but an employee rehired within 37 weeks gets unused leave back unless it was paid out.
