Handing Over A Firearm

Md. Code, Pub. Safety § 5-124 — a secondary sale of a regulated firearm, 7 days after the application, through a licensee or a designated agency

Seven days. A person who is not a licensee may not sell, rent, transfer or purchase a regulated firearm until 7 days after the buyer's firearm application is executed and forwarded by a licensee to the Secretary.

A licensee or an agency. As an alternative to completing a secondary sale through a licensee, the parties may complete it through a designated law enforcement agency. A licensee may charge the applicant a processing fee not exceeding $20.

90 days, then report. The transfer is completed within 90 days after the application is stamped not disapproved, or the application is returned within 7 days. The seller forwards notice of the completed transfer to the Secretary within 7 days after delivering the firearm.

What counts as a regulated firearm is defined elsewhere in the title. Federal law adds its own rules on transfers, including to people who live in another state, which are not on this page. Whether a particular sale, loan or gift is lawful is a question for a licensed Maryland attorney.
