Md. Code, Transp. § 11-114 — to drive includes being in actual physical control of a vehicle
The definition. To drive means to drive, operate, move, or be in actual physical control of a vehicle, including exercising control over or steering a vehicle being towed by a motor vehicle.
Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed Maryland attorney.
