Minn. Stat. 260E.06 — professionals and clergy report immediately, anyone else may

In Minnesota, a person who knows or has reason to believe a child is being maltreated, or has been within the preceding three years, immediately reports to the local welfare agency, the police, the county sheriff or the other agencies the section names, if the person is a professional in the healing arts, social services, hospital administration, psychological treatment, child care, education, correctional supervision or law enforcement, or is clergy who learned it in ministerial duties.

  • Any other person may report voluntarily.
  • An employer or similar entity may not have policies that keep a mandated reporter from making a report.

What counts as abuse or neglect, the immunity a good faith report carries, and the confidentiality of the reporter are set in other sections and are not reproduced here. In an emergency, the police come first. Whether a duty applied in a particular case is a question for a court and for a licensed Minnesota attorney.
