A Claim Against the Government
Neb. Rev. Stat. § 13-919 — a written claim within one year, and suit within two
Every claim against a Nebraska political subdivision under the Political Subdivisions Tort Claims Act is forever barred unless it is made in writing to the governing body within one year after it accrued.
Who handles this in Nebraska: legal aid programs, lawyer referral and the state offices, listed in the Nebraska directory.
Suit is begun within two years after the claim accrued. Where that would end sooner, the time to sue runs until six months after the governing body mails notice of its final disposition of the claim, or after the claim is withdrawn.
Whether a claim falls under the act, and whether an exception applies, are questions for a licensed Nebraska attorney.
