Neb. Rev. Stat. § 25-2802 — claims up to seven thousand five hundred dollars, no attorneys, and no jury

Seven thousand five hundred dollars. The Small Claims Court hears civil actions of any type where the money, damages or value of property claimed does not exceed seven thousand five hundred dollars, beginning July 1, 2025, not counting interest and costs.

The case is brought in the county where the defendant lives or does business, or where the claim arose.

  • No party is represented by an attorney; an individual appears for themselves, and a business through an employee or member.
  • Only a party to the transaction may file; an assigned claim may not be filed.
  • No party may file more than two claims in a calendar week, or more than ten in a calendar year.

The plaintiff pays a fee of six dollars and twenty-five cents at filing. Notice is served on the defendant not less than five days before the hearing.

A defendant may file a setoff or counterclaim at least two days before trial, and may move the case to the regular county court docket by giving notice at least two days before the hearing.

No jury. Every matter in the Small Claims Court is tried to the judge without a jury. Any party may appeal to the district court, and attorneys may appear on appeal.

An appeal from the county court is perfected within thirty days after the judgment is entered. A particular claim is a question for a licensed Nebraska attorney.
