A Sale At Your Door
Neb. Rev. Stat. § 69-1603 — three business days to cancel a home solicitation sale, and the money back in ten days
A home solicitation sale is a sale, lease or rental of consumer goods or services of twenty-five dollars or more, personally solicited, where the buyer agrees somewhere other than the seller's place of business.
Three business days. The buyer may cancel until midnight of the third business day after the seller gives the written notice of the right to cancel.
Cancellation is by mail to the seller and is given when mailed. It needs no particular form; any writing showing the buyer does not intend to be bound is enough.
The contract carries a notice under the caption BUYER'S RIGHT TO CANCEL in at least ten-point boldface type, and in the buyer's language if the seller sold in it.
Ten days. Within ten days after cancellation, the seller returns all money paid, including any down payment, and the buyer owes no finance or other charge.
A sale made after negotiations at a store, or one the buyer started for a genuine emergency and waived in handwriting, is outside the rule. A particular sale is a question for a licensed Nebraska attorney.
