Littering
Neb. Rev. Stat. § 28-523 — any waste on public or private property or water, and the driver answers for the car
Throwing or dumping litter on any public or private property or into any waters is littering, unless it goes in a receptacle or a place lawfully designated for it.
From a car. When litter is thrown from a motor vehicle or boat, the operator commits the offense.
Littering is a Class III misdemeanor, and a Class II misdemeanor the second time.
Waste from the primary processes of farming or manufacturing is not litter under the section. A particular citation is a question for a licensed Nebraska attorney.
