Taking A Car Without Asking
Neb. Rev. Stat. § 28-516 — operating another's vehicle without consent, and the belief the owner would have said yes
Intentionally operating another person's car, motorcycle, boat, plane or other motor-propelled vehicle without the owner's consent is unauthorized use of a propelled vehicle.
A defense. It is an affirmative defense that the person reasonably believed the owner would have authorized the use had the owner known of it.
It is a Class III misdemeanor the first time, a Class I misdemeanor the second, and a Class IV felony the third and after.
Intending to keep the vehicle makes it theft instead. A particular charge is a question for a licensed Nebraska attorney.
