When Your Data Is Breached

Neb. Rev. Stat. § 87-803 — an investigation, notice as soon as possible, and the Attorney General told too

A breach of the security of the system is the unauthorized acquisition of unencrypted computerized data that compromises the security, confidentiality or integrity of personal information.

Notice without unreasonable delay. A business that learns of a breach investigates promptly. If misuse of a Nebraska resident's information has occurred or is reasonably likely, it notifies the resident as soon as possible and without unreasonable delay.

The business notifies the Attorney General no later than the time it notifies the residents.

Notice may wait on the legitimate needs of law enforcement. A particular breach is a question for a licensed Nebraska attorney.
