Who Cannot Carry
NRS 202.360 — a felony, domestic battery, stalking, an extended protective order, unlawful drug use, or a mental health adjudication
Nevada bars these people from owning a firearm, possessing one, or having one under their custody or control. Owning or possessing in violation of this list is a category B felony, punished by a minimum term of not less than 1 year and a maximum of not more than 6 years, and a fine of not more than $5,000 may be added.
- A person convicted of battery constituting domestic violence against a spouse or former spouse, a dating partner, the other parent of the person's child, the person's parent, or the person's child or ward.
- A person convicted of a felony anywhere, unless pardoned and the pardon does not restrict the right to bear arms.
- A person convicted of stalking where the court entered the finding the stalking statute provides for.
- A person currently subject to an extended order for protection against domestic violence that bars firearms, or an equivalent order of another state.
- A fugitive from justice, or an unlawful user of, or someone addicted to, a controlled substance.
- Anyone otherwise prohibited by federal law.
A second list carries a category D felony: a person adjudicated mentally ill or committed to a mental health facility by a court, a person who pleaded or was found guilty but mentally ill, a person acquitted by reason of insanity, and a person illegally or unlawfully in the United States.
Loaded or not, working or not. For this section a firearm includes one that is loaded or unloaded, operable or inoperable.
Using, carrying or possessing a firearm in furtherance of the drug trafficking offenses the section names is a separate category B felony. How a prohibited person gives up a firearm is in another section and is not reproduced here. Whether a particular conviction or order brings someone within the list is a question for a court and a licensed Nevada attorney.
