Earned Sick Leave

N.J.S.A. 34:11D-2 — one hour for every 30 worked, up to 40 hours a year

One hour for every 30. In New Jersey, every employer provides earned sick leave: one hour for every 30 hours worked, though an employer need not allow more than 40 hours to accrue, be used or carry forward in a benefit year. An employee may use it from the 120th calendar day after starting work, unless the employer agrees to an earlier date.

  • Caring for a family member who is ill or getting preventive care.
  • Medical care, counseling, relocation or legal help after domestic or sexual violence against the employee or a family member.
